..

Petitioner And The State of Telangana, Rep., by its Principal Secretary, School Education Department, Secretariat Buildings, Hyderabad & others.

.. Respondents This court made the following :

- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.21954 of 2018 ORDER :

Heard.

2.

Petitioner is working as Secondary Grade Teacher in Upper Primary School, Beerolli, Mandal Parishad Gadwal, Jogulamba Gadwal District, from 19.08.2009. Her husband is working as Secondary Grade Teacher in M.P.P.S., Ananthapuram, Mandal Parishad Gadwal from 18.08.2009. Consequent to lifting of ban on transfers Government notified rules vide G.O.Ms.No.16 dated 06.06.2018 and undertaken the exercise of transfers to various categories of teachers. Rule 6 of the Telangana Teachers (Regulation of Transfers) Rules, 2018 (for short 'the Rules, 2018') deals with Entitlement Points, under 'II -Special Points (Extra Points) spouse is entitled to 10 points, if the spouse is working in the same district. According to clause 'd', only one of the spouse is entitled for spouse points, if both are working in the same district.

Admittedly, husband of petitioner has applied in the transfer counseling and has claimed 10 weightage points. Thus, petitioner is not entitled to weightage points. That being so, after the last day for submission of application and freezing of applications is over, petitioner submitted representation to delete the weightage points granted to her husband and to grant weightage points to her. 3.

After the last date for submission of application and the applications submitted were already freezed, it is not open to one spouse to change option for weightage points already sought by another spouse and granting of weightage points to that spouse.

- 3 - The provision in Rule 6 of the Rules, 2018 cannot be stretched that far and to create uncertainty in the transfer councelling process. Therefore, I do not see any merit in the claim of petitioner to accept her request to add entitlement points to her account instead of her husband. The writ petition merits no consideration and is liable to be dismissed.

4.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
