ORDER :
Disciplinary proceedings were initiated against the petitioner, which resulted in issuing show-cause notice on 31.03.2017. Petitioner challenges the said show-cause notice on various grounds. One of the grounds urged is, has no confidence in the Depot Manager, TSRTC, Warangal-2 Depot and same was expressed to the Depot Manager at the initial stage itself, whereas he ignored such objection and issued show-cause notice. 2.
At this stage, Sri Vidya Sagar, learned senior counsel appearing for the respondent-Corporation, on instructions, submits that the disciplinary authority would be changed and new disciplinary authority from out side region would be appointed and same shall be intimated to the petitioner. Learned counsel for petitioner agrees for the suggestion of the learned senior counsel. 3.
In view of these developments, Court is not inclined to go into other issues at this stage and dispose of the writ petition with the following directions:
i) The competent authority shall nominate another Officer as disciplinary authority from any other region other than the Warangal region and intimate the petitioner about the change of the disciplinary authority ;
ii) Petitioner shall respond to the show-cause notice dated 31.03.2017 within two weeks from the date of intimation of the appointment of another disciplinary authority;
iii) It is open to the petitioner to raise all the contentions as available in law including the contentions urged in this writ petition and all the issues are left to be agitated by the respective parties; and iv) Petitioner shall co-operate for early disposal of the disciplinary action. In the event of petitioner not cooperating, it is open to the disciplinary authority to take further course of action as warranted by law.
