HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4474 of 2013 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 to 3 under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.900 of 2007 on the file of III Additional chief Metropolitan Magistrate, Gajuwaka, Visakhapatnam against the petitioners/ accused Nos.1 to 3, where the learned Magistrate has taken cognizance for the offence punishable under Section 420 IPC in Crime No.293 of 2007 of Gajuwaka Police Station, Visakhapatnam, which is outcome of report of 2nd respondent/ de facto complainant.

2) When the matter came up for hearing, there is no representation on behalf of the petitioner and the respondent State represented by the Public Prosecutor submitted that the above calendar case was ended in acquittal after full dressed trial and no cause survives for adjudication in this criminal petition and the same has become infructuous.

3) Recording the said submission, this criminal petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed.
