HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.Nos.39108 OF 2013 & 936 OF 2014 COMMON ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petitions, the petitioners seek direction thereby calling for records pertaining to order dated 07.08.2013 passed in O.A Nos.173 of 2012 and 1015 of 2012 on the file of Central Administrative Tribunal, Hyderabad Bench, Hyderabad and quash the same by declaring illegal, arbitrary and contrary to law.

2. Learned Assistant Solicitor General appearing on behalf of the petitioners does not dispute the communication dated 22.11.2017 passed by DRDO and submits that the petitioners have sought permission from the Ministry to withdraw the present petition.

2. Vide the communication dated 22.11.2017, whereby communicated as under:

"In keeping with M/s Finance UO No.8-10/2017-E-III(A) dated 03 August, 2017 and in modification of Para 2(II) of this Department, letter No.DRDO/85101-A/V CPC/MPD/D (R&D) dated 03 February 1999, it has been decided that the two additional increments sanctioned as a part of incentive to Scientist 'C', Scientist 'D', Scientist 'E' and Scientist 'F' shall be treated as pay for payment of Dearness Allowance, House Rent Allowance and Pension & Pensionary benefits w.e.f. 01 January, 1996. However, the two additional increments shall not be counted for pay fixation on promotion."

In view of the above communication mentioned above, the present writ petitions have become infructuous. Accordingly, these Writ Petitions are dismissed as infructuous. No order as to costs.

Miscellaneous Petitions, if any pending, shall stand closed.
