HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.7340 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to relax the bail condition in the order dated 15.04.2015 passed in Crl.M.P.No.1178 of 2015 in CC.No.1 of 2018 in R.C.No.3(E) of 2013-CBI/BSFC/Bangalore by the learned XIV Additional Chief Metropolitan Magistrate, Hyderabad.

Learned counsel for the petitioner/accused No.2 contended that the petitioner is no longer employed with DCHL and seeking to commence new business in India for his livelihood and required to travel abroad not only for various business purposes and meetings and to attend the Courts in Europe and Asia for pending litigation instituted by him but also to visit his daughter who works and resides in USA, therefore seeking relaxation of the condition imposed by the Magistrate that the petitioner shall not leave without prior permission of the Magistrate. It is further submitted that the meetings abroad with prospective investors and partners are scheduled under very short notice and it is not feasible to obtain the Magistrate's permission within time to travel abroad for said meetings. It is further submitted that till now the petitioner has always sought permission of the Magistrate to travel abroad and has not deviated from this condition at any point of time. It is also submitted that the petitioner is a

law abiding citizen and permanent resident of India, hails from a very reputed family and his family members reside in India and never breached any condition imposed upon him and sought for relaxing the condition that the petitioner shall not leave India without permission of Magistrate by allowing the criminal petition.

Sri K. Surender, learned Special Public Prosecutor for CBI, vehemently opposed the criminal petition. A perusal of the material on record shows that there is no illegality in imposing the condition by the Magistrate and there is nothing to interfere with the impugned condition. Having regard to the above and in the result, this Criminal Petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
