THE HON'BLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE No.1590 OF 2018 ORDER:

In W.P.No.11089 of 2018, as the Court was informed that petitioner filed application in Form VI-A for mutation of his name in the revenue records and issuance of pattadar passbook and title deeds before the Tahsildar, Saidapuram Mandal, SPSR Nellore District, and the same is pending before him, the Tahsildar was directed to examine the claim of the petitioner and to pass orders in accordance with law.

In the counter affidavit, the respondent narrates the steps taken by her on the applications filed by the petitioner. It appears, the earlier applications were rejected even before the Writ Petition was instituted and on 03.04.2018 and 12.04.2018 notices were issued to the petitioner to attend the office for enquiry. However, by order dated 04.04.2018, the Writ Petition was disposed of without noticing these facts. It appears, by proceedings dated 07.02.2018 and 28.07.2018, notional khatha numbers allotted to the petitioner were ordered to be replaced by regular khathadar number with Khatha No.269 and accordingly orders were implemented in Web Land Adangal and 1-B Register. On 27.06.2018, petitioner filed a petitioner addressing the Tahsildar, Saidapuram Mandal, requesting to take action as per the orders of the Court. It appears, on 28.06.2018 notice sent to the petitioner informing about allotment of regular Khatha number and implementation in Web Land Adangal and 1-B Register and also informed him to apply afresh in Mee-Seva in prescribed form.

It appears, this notice was sent through registered post. According to respondent, unless petitioner applies through Mee-Seva for issuance of pattadar passbook and title deeds, no further steps can be taken.

In view of the same, it cannot be said that respondent has violated the directions issued by this Court warranting initiation of contempt proceedings.

The Contempt Case is accordingly closed.
