THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2642 OF 2016 ORDER:

This petition is filed by the petitioner-A1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.9 of 2016 on the file of the Achanta Police Station, Achanta, West Godavari District, registered for the offence punishable under Sections 376, 417 and 420 IPC.

Heard and perused the material available on record. Even though the offence alleged against the petitioner is punishable with more than seven years imprisonment, but the contents in the complaint reveals that there was a love affair between the petitioner and the 2nd respondent and subsequently, the petitioner refused to marry her.

Considering the above circumstances, the 1st respondentpolice are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting the petitioner-A1. In the event of necessity, the 1st respondent-police are directed to issue a notice to the petitioner-A1 for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating officer and give an undertaking as to his future appearance as and when required by the investigating agency for the purpose of investigation. The petitioner is also directed to co-operate with the investigating agency and subject himself for medical examination whenever required by the investigating agency. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 17.3.2016 Nn
