THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7201 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A1 seeking bail in the event of his arrest in connection with Crime No.211 of 2022 on the file of KPHB Colony, Cyberabad District, registered as 'women missing'. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he had taken the victim girl who is aged 17 years. On coming to know that the petitioner had taken the said girl, a complaint was lodged which was registered as 'women missing'.

Learned Counsel for the petitioner submits that in fact, both the petitioner and the victim girl had married on 12.05.2022 at Sri Podala Laxmi Narasimha Swamy Devastahanam, Thamminayanapalli Village, Gorantla Mandalam, Satya Sai District; and that the said marriage was certified by the Sub-

Registrar and a marriage certificate dt.12.05.2022 was also issued.

Learned Assistant Public Prosecutor submits that it appears that though the girl was aged 17 years, there was a mis-representation which was made before the Sub-Registrar. 6.

In the event of such mis-representation being made, the police are at liberty to take action in accordance with law. However, since there is evidence that the petitioner and the girl married and the same was registered under Hindu Marriage Act, this Court deems it appropriate to grant relief of Anticipatory Bail to the petitioner in the event of his arrest, subject to the following conditions:

1) The petitioner/A1 is directed to surrender before the Station House Officer, KPHB Colony Police Station, Cyberabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioner/A1 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A1 shall appear before the concerned Station House Officer every Monday between 10.00 a.m. to 1.00 p.m. for a period of six (6) weeks, for the purpose of investigation.

3) The petitioner/A1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
