THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31591 of 2017 ORDER:

When the matter is taken up, learned Government Pleader for Mines & Geology has placed on record the written instructions furnished by the Assistant Director of Mines & Geology Eluru. The relevant portion of the said instructions reads as under:

"It is submitted that, at the time of EAuction system as per instructions of the Secretary (Mines) & Director of Mines and Geology the District Collector and Magistrate, West Godavari District has cancelled the six (6) sand reaches i.e.

1) Dachavaram, 2) Vinjaram and 3) brahimpatnam, of Kukunuru Mandal and 4) Repakugummu, 5) Rudrammakota and 6) Thirumalapuram of Velairopadu Mandal of West Godavari District due to there is no feasibility for transportation i.e. no road connectivity to the sand reaches and also to avoid illegal transportation to the out of State i.e. Telangana vide Proc.No.M & G-SAND/8/2016 dated 07.04.2016 of the District Collector.

Hence, it is submitted that, there is no feasibility for transportation of sand at Ibrahimpatnam Ganapavaram Village limits, Kukunuru Mandal, West Godavari District i.e. no road connectivity to the sand reach and also to avoid illegal transportation to the out of State i.e. Telangana the said reach was cancelled by the District administration.".

In view of the above, no relief can be granted in the present Writ Petition. Accordingly, the Writ Petition is closed. As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed. __________________ A.V.SESHA SAI, J 03rd October, 2017 Tsy
