THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4985 OF 2016 ORDER:

This Criminal Petition is filed by petitioner-accused No.5 under Section 482 Cr.P.C. seeking to quash the proceedings against her in Crime No.308 of 2010 on the file of Penamaluru Police Station, Vijayawada City, Krishna District, registered for the offence punishable under Sections 420 and 506 IPC.

Heard and perused the material available on record. It is alleged that A1 to A4 promised to give 1/4th share to the 3rd respondent in their Real Estate Business at Vijayawada, for which, they took signatures and thumb impressions of the 3rd respondent and they also took three blank cheques and three blank pronotes from him. The above accused induced him to give some more amounts to them to get huge profits. The 3rd respondent paid Rs.40 lakhs to them. The accused cheated the 3rd respondent-complainant and created a sale deed in respect of his land in favour of the petitioner herein. The learned Counsel for the petitioner submitted that the 3rd respondent wrote a letter dated 6.12.2010 to the S.H.O Penamaluru stating that the allegations against the petitioner are not correct and therefore, the allegations made against her are withdrawn.

Considering the facts and circumstances of the case and the letter dated 6.12.2010, the 1st respondent-police concerned are directed not to arrest the petitioner. However, the 1st respondentpolice are directed to file a final report after due investigation. Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand

closed.
