THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.25640 of 2019 ORDER:

The present writ petition is filed to declare the action of the fourth respondent in not registering the case on the basis of the representation of the petitioner, dated 24.10.2019, as being illegal, arbitrary and unjust. 2.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, based on the written instructions, 22.11.2019, submits that the petitioner sent a complaint to the fourth respondent through registered post, which was received, on 04.11.2019. Upon receipt of the above complaint, a GD entry was made on the same day and as the contents of the petition are noncognizable in nature, a letter was addressed to the II Additional Judicial First Class Magistrate, Armoor, to accord permission to register a case. Learned AGP further submits that after obtaining permission from the learned II Additional Judicial First Class Magistrate, on 09.11.2019, a case was registered in Crime No.106 of 2019 for the offences punishable under Sections 427, 290 and 506 IPC on the file of Morthad Police Station, on 09.11.2019 itself. A copy of the written instructions is placed on record of this Court.

In view of the above submissions, inasmuch as the grievance of the petitioner as to non-registration of the crime has been redressed, no orders need be passed in this writ petition,
