ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 and A2 seeking to quash the proceedings in Cr.No.76 of 2016 of Chaderghat Police Station, Hyderabad, registered for the offences punishable under Sections 363, 380, 506 r/w 34 IPC, against them.

Heard learned counsel for the petitioners/A1 and A2 and learned Additional Public Prosecutor representing the State. 3.

It is alleged in the complaint that the husband of de facto complainant, by name, Mohd. Javed Ahmed Siddiqui, died while undergoing treatment on 28.01.2016. A1, who is the first wife of said Siddiqui, gave birth to a male child through him and thereafter, she took divorce. After the death of said Siddiuqui, A1 used to come to the house of de facto complainant frequently and that on 01.02.2016, A1 along with the other accused kidnapped her male child and also stolen all the valuable documents and jewellery.

4. Since there are certain allegations in the complaint against the petitioners/A1 and A2, this Court is of the considered view that this is not a fit case to quash the impugned proceedings. However, considering the facts and circumstances of the case and the petitioners/A1 and A2 being the women, the police concerned are directed to proceed with the investigation without arresting them. The petitioners/A1 and A2 are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

5. With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
