W.P.No.16332 of 2015 O R D E R:

This writ petition is filed under Article 226 of the Constitution of India, for the following relief:

"to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 and 3 in not registering the complaint dated 6.6.2015 and 29.5.2015 made by the petitioner against the culprits who are accused in the complaint as illegal, arbitrary and against the principles of natural justice and consequently direct the respondents no.2 and 3 to register the complaint and take necessary action on the complaints of the petitioner and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice.."

2. Heard Sri Deepak Misra, learned counsel for the petitioner and the learned Government Pleader for Home.

3. When the matter is called today, written instructions dated 18.06.2015 furnished by the Sub-Inspector of Police, Kollipara Police Station, Guntur Rural District have been placed on record by the learned Government Pleader and the same read as under:

"It is respectfully submitted that the Desaboina Tirupathamma who is the grand mother of the petitioner lodged her hospital statement through Tapalla against one Tadiboyina Nageswara Rao and 7 others stating that on 05.06.2015 that they attached them by using filthy language and beaten with hands, warned that they will kill her regarding property dispute.

It is further submitted that the same was received on 10.06.2015 after receiving the same a case was registered in Cr.No.51/2015 U/Sec.323, 509, 506 r/w 34 IPC of Kollipara PS Guntur Rural District, the investigation officer took up the investigation, during the course of the investigation 6 witness were examined and recorded their statements. It is further submitted that during investigation it reveals that the entire disputes between the accused and complaint is property dispute. After completion of investigation the respondent police will taking steps to file final

report before Competent appropriate Court.

The allegations made against the respondent police by the petitioner are false and baseless.

The respondent police will abide the directions if any passed by this Hon'ble Court."

4. On noticing the said instructions, the learned counsel for the petitioner requested this Court to dispose of the writ petition by recording the said instructions.

5. In view of the above submission, the writ petition is disposed of, recording the instructions dated 18.06.2015 furnished by the Sub-Inspector of Police, Kollipara Police Station, Guntur Rural District. As a sequel, pending miscellaneous petitions, if any, shall stand disposed of. No costs.
