THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3756 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioners/A-1 and A-2 seeking to quash the proceedings in S.T.C.No.122 of 2011 on the file of the Judicial First Class Magistrate at Jammalamadugu, YSR Kadapa District.

2. Heard and perused the material available on record.

3. The petitioners are alleged to have committed the offences punishable under Section 92 of the Factories Act, 1948 for contravention of Section 7-A(2)(a&c) read with Section 41 read with Rule 61-B(2)(3)(4) read with Rule 61 F (2&3).

4. After arguing for sometime, learned counsel for the petitioners while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court. He also submitted that N.B.Ws are pending against the petitioners and requested to recall the warrants issued against the petitioners, as the petitioners are ready to face the trial and will not flee from the hands of justice.

5. The offences are triable summarily and the presence of the petitioners before the trial Court is also not necessary. Hence, the petitioners are directed to approach the Court concerned and file a petition to recall the warrants issued against them and on such petition being filed, the Court concerned is directed to recall the warrants on the same day on their execution of a bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each and the presence of petitioners/A-1 and A-2 before the trial Court is

dispensed with except on the dates on which the learned Magistrate insists for their appearance.

The petitioners shall be properly represented through their counsel before the trial Court.
