Heard.

The petitioner's grievance is that his representation, dated 19.03.2015 seeking release of vehicle bearing No.AP-37-TC-1644 is not being considered by the 3rd respondent.

Learned Government Pleader has received instructions, which state a case in Cr.No.86 of 2015 was registered under Section 420 IPC on the file of the 3rd respondent and the aforesaid vehicle was seized on 15-02-2015 during investigation of the said crime and was later produced before the XX Metropolitan Magistrate, Malkajgiri, on 17-04-2015. It is stated that the investigation is still pending. The vehicle being in the custody of the said court, the 3rd respondent cannot pass any orders on the petitioner's request for its release. In view of the vehicle being already in the custody of the competent criminal court, the petitioner is at liberty to approach the said Court and seek release of the vehicle on the grounds, which are set out in the affidavit herein. If any such application is filed, the learned Magistrate would consider the same and pass appropriate orders in accordance with law.
