CVNR, J & MSKJ, J FCA.No.105 of 2008 Dt:17.11.2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Family Court Appeal arises out of order, dated 03.10.2006, in O.P.No.390 of 2004, whereby the Judge, Family Court, Hyderabad, has dismissed the said O.P. filed by the appellant seeking dissolution of marriage with respondent No.1. At the hearing, there is no representation for the appellant. Respondent No.1 is represented by Mr. Surendra Desai, Advocate.
The Deputy Director, Mediation and Arbitration Centre, attached to this Court addressed letter, dated 07.9.2016, to the Registrar (Judicial), wherein he has informed that as per the mediator's report, dated 30.8.2016, the dispute is settled between the parties. Along with this letter, the copies of the Mediator's report and the Settlement Agreement have been filed. It is mentioned in the Settlement Agreement that the appellant and respondent No.1 agreed to live together and continue matrimonial life without any conditions with their free will.
In the light of the afore-mentioned settlement, the necessity for adjudicating the Family Court Appeal on merits is obviated. The Family Court Appeal is, accordingly, dismissed as infructuous.
