HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.15615 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the learned standing counsel for APSRTC.
2. On 08.03.2015 when the petitioner was performing duties as driver, a check was exercised and charge sheet was issued to him making charges on certain irregularities. Thereafter, the petitioner was suspended by order dated 09.04.2015, which is impugned in the present writ petition.
3. Learned counsel appearing for the petitioner submits that the petitioner is a patient of HIV, so also his children. His wife expired with the same disease. He further submits that keeping the petitioner under prolonged suspension, without even appointing the enquiry officer, causes much hardship and injury to him.
4. Considering the submissions made by the learned counsel appearing for the petitioner, as well as the standing counsel for the respondents-Corporation, the writ petition is disposed of directing the 2nd respondent to conduct enquiry and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order, failing which the order of suspension shall stand revoked.
