This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the in action on the part of the 3rd respondent in impounding the possessory agreement of sale deed dated 19-01-2010 by collecting deficit stamp duty from the petitioner as being arbitrary and illegal and to pass appropriate consequential orders, in the interest of justice. 2.

Heard learned counsel for the petitioner and the learned Asst.

Government Pleader for Revenue appearing for the respondents.

It is stated by learned counsel Asst. Government Pleader for Revenue that the petitioner has filed only a photo copy of the agreement of sale deed dated 19-01-2010, which cannot be impounded and, if the original agreement of sale deed is filed appropriate action will be taken in accordance with law. Learned counsel also states that a counter affidavit is filed in the matter to the same effect.

Recording the submission made by the learned Asst. Government Pleader for Revenue, the 3rd respondent is directed to take action in accordance with law and impound the agreement of sale dated 19-01-2010, if the petitioner produced the original document (agreement of sale dated 19-01-2010) for impounding, within a period of four weeks from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly.
