THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9074 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.171 of 2023 on the file of Kachiguda Police Station, Hyderabad, registered for the offences under Sections 8(c) r/w. 20 (c) and 27 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner was apprehended along with A-1. It is the case of the Kachiguda Police that this petitioner and another was apprehended in the Railway Station. 14gms. of MDMA drug was recovered from the possession of A-1. According to the investigation, this petitioner and A-1 had purchased the said drug from A-3.

However, since the allegation that the drug was purchased and sold is on the basis of confession and no recovery is affected as far as this petitioner is concerned, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties i.e., one local surety and the other from his native place for a like sum each to the satisfaction of IV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer on every Monday and Wednesday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
