THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.9045 & 9066 OF 2023 COMMON ORDER:

These Criminal Petitions are filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.7, 8, 11 and 12 seeking bail in the event of their arrest in connection with Crime No.167 of 2023 on the file of Kulsumpura Police Station, Hyderabad, registered for the offences under Sections 341, 307 and 427 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The complaint was lodged on 21.06.2023 alleging that nearly 17 persons attacked the de-facto complainant. It is alleged that the said attack was in Methar Basthi. These petitioners were part of 17 persons who had attacked him. The de-facto complainant received grievous injuries.

Since specific over tacts are not attributed to these petitioners, they can be granted the relief of anticipatory bail, subject to the following conditions:

1) The petitioners/Accused Nos.7, 8, 11 and 12 are directed to surrender before the Station House Officer,

Kulsumpura Police Station, Hyderabad, on 26.09.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused Nos.7, 8, 11 and 12 shall appear before the concerned Station House Officer at 10.00 A.M everyday for a period of three weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.7, 8, 11 and 12 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 5.

Accordingly, these Criminal Petitions are allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
