THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU CI VI L REVI SI ON PETI TI ON No.3150 of 2014 ORDER:

This civil revision petition is filed questioning the order, dated 11.08.2014, passed in I.A.No.305 of 2014 in O.S.No.1656 of 2006, by the II Additional Junior Civil Judge, Kakinada.

During course of hearing, both the learned counsels agreed that this revision petition is filed against the order in I.A.No.305 of 2014. I.A.No.305 of 2014 is an application filed under Order 16 Rule 5 CPC requesting the court to issue summons to the Sub-Registrar, Kakinada to produce the Thumb Impression Register relating to three sale deeds. Along with this application, I.A.No.303 of 2014 was filed to send the registers and Ex.A7 document to handwriting expert for comparison. Both the applications are dismissed. However, the revision petition is filed only against the order passed in I.A.No.305 of 2014, which is filed to summon Thumb Impression Register. The order passed in I.A.No.303 of 2014 has not been challenged. The said order has become final. Therefore, production of the Thumb Impression Register at this stage will not serve any purpose.

In that view of the matter, the civil revision petition is dismissed. In the circumstances, no costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
