HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22000 of 2018 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue a writ order or direction more particularly a writ in the nature of Mandamus i) declaring the inaction on the part of the Respondents 1 to 6 in not registering the case on the complaint given on 18.06.
2018 as illegal, Arbitrary and capricious ii) to direct the respondents 1 to 6 for providing sufficient protection to the person and properties of the members of the Petitioners society for their peaceful living in their properties from the hands of un social elements and to stop the actions of the unsocial elements from digging trenches around their properties causing damage to the properties of the members of the petitioners society, compelling them to vacate their properties and preventing their access to their properties iii) to direct the respondents No 1 to 6 not to interfere with the civil matters and civil disputes relating to the properties of the members of the petitioner society which are already pending before the civil courts and to respect the orders of the courts." 2.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents. 3.
Learned Assistant Government Pleader for Home produced written instructions stating that basing on the compliant of the petitioner, a case in Crime No.366 of 2018 was registered on 30.06.2018 and police are not interfering with the civil disputes, except investigating into the aforesaid crime. He further stated that the petitioner filed an application seeking police protection and the same would be considered in accordance with law. 4.
Recording the submission made by learned Assistant Government Pleader for Home, the Writ Petition is disposed of
directing the competent authority to consider the application stated to be filed by the petitioner seeking police protection and take action in accordance with law.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
