THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33375 of 2016 ORDER :
This writ petition is filed praying to grant the following relief : "To declare the action of the respondents in not considering representation of the petitioner dated 19.07.2016 and 23.07.2016 as illegal, arbitrary and unconstitutional or consequently direct the respondents to restore water supply to the petitioner premises bearing H.No.12-2-416/64/G1, of CAN No.618484537".

Learned counsel for the petitioner would submit that without prior notice and without any justification the water supply is disconnected and inspite of submitting the representations and payment of water charges, so far connection is not restored, causing lot of hardship to the petitioner.

Learned Standing counsel produced notice dated 29.06.2016 wherein the petitioner was informed that subject premises is classified as Multi Storied Building as per the Rules of the Board and therefore, petitioner was requested to apply for enhancement of connection under M.S.B. category. Petitioner acknowledged the said notice and submitted his representation on 01.07.2016.

There is no mention about the notice issued to the petitioner and his representation in the subsequent representations and even in the affidavit filed in support of the writ petition.
Since a notice was already issued to the petitioner for enhancement of the connection as per M.S.B. category Rules, the cause in the writ petition does not survive.

Hence, the Writ petition is dismissed, leaving it open to the petitioner to avail appropriate remedies against the notice dated 29.06.2016, if he is so advised. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
