THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.32340 of 2022 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Stamps and Registration appearing for the respondents. With their consent, the writ petition is taken up for disposal at the stage of admission.

It is submitted by the learned counsel on either side that subject matter of this writ petition is squarely covered by the common order passed by this Court in W.P.No.44223 of 2018 and batch, dated 22.03.2022, as such, this writ petition may be disposed of in terms thereof.

Therefore, following the common order dated 22.03.2022, in W.P.No.44223 of 2018 and batch, for reasons alike and in terms thereof, this writ petition is disposed of as under without any order as to costs:

"As per Rule - 58 of the Telangana Rules under the Registration Act, 1908 (for short 'the Act'), it is relevant to note that the Registering Authority has no right to enquire about the validity of a document. It is also relevant to note that mere registration of a document will not entitle the petitioner to claim right over the subject property as it is only conveyance of property and it will not create any right. The Registering Authority is directed to receive the documents produced by the petitioner and complete the registration formalities, if the same are otherwise in order. If the Registering Authority refuses to register the

documents, he/she has to specifically assign reasons in terms of Section - 71 of the Act."

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
