THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.19896 of 2014 ORDER:

Today, when the matter is taken up, written instructions dated 7.8.2014 furnished by the Sub-Inspector of Police, Parchur Police Station, Prakasam district are placed on record by the learned Government Pleader. The said written instructions read as under:

"The facts of the case are that on 11.7.2014 the Village Revenue Officer-I of Parchur village has submitted a complaint with the SHO Parchur P.S. stating that the Parchur Mandal Surveyor with staff were attended along with him to measure the disputed site at the house of the petitioner near Kollavri Kalyanamandapam, Parchur village and there was a mob altercating the words in loud voice and expecting galata and the complainant/VRO requested the police to provide protection to avoid the galata.

It is submitted that basing on the said complaint the SHO has deputed Asst. Sub Inspector of Police-989 and Police Constable-393 to the spot to maintain law and order. The revenue authorities have stopped the measurement work and left the place and no untoward incident was happened at the place. Hence, the police official have returned back.

It is submitted that except receipt of complaint from the Village Revenue Officer, the SHO Parchur has never harassed, threatened, interfered and insisted the petitioner to vacate the said land at any point of time.

It is respectfully submitted that as of now no complaint was received and no criminal case was registered against the petitioner herein on the file of this respondent police station.

It is submitted that the contention of the petitioner that this respondent has sent police constables frequently to the house of the ept and insisted to appear before the police station and further the police have trespassed into the house of the petitioner herein is incorrect, baseless and far from truth and have been created for the purpose of filing the present writ petition.

At no point of time this respondent has tried to settle the civil dispute between the petitioner herein and his brother and the police has

fixed dead line for one week for vacating the house and site, hence the same is hereby denied".

On noticing the same, a request is made by the learned counsel for the petitioner to place on record the said written instructions. 3.

In view of the above, the writ petition is disposed of, by placing on record the said written instructions dated 7.8.2014 furnished by the SubInspector of Police, Parchur Police Station, Prakasam district. As a sequel, the Miscellaneous Petitions, if any, shall stand closed. There shall be no order as to costs.
