THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.30339 of 2012 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the inaction of respondents no. 3 to 5 in preventing illegal and unsocial activities and nuisance at the toddy shop located near RTC Bus stand beside Hajipally road, Shadnagar town, Mahabubnagar District is illegal, arbitrary and violative of Art. 21 of Constitution of India. and consequently direct the respondents to shift the toddy shop to the outskirts of Shadnagar town."
Today, when the matter is called, it is requested by the learned counsel for the petitioners that the petitioners herein may be permitted to make a representation to the respondent authorities and the same be considered by the respondent authorities, in accordance with law, by fixing some time frame. The said request is not opposed by the learned Government Pleader for Prohibition and Excise.
In view of the above, the writ petition stands disposed of, keeping it open for the petitioners herein to make necessary representation to the respondent authorities for redressal of their grievance within a period of four (4) weeks from the date of receipt of a copy of this order and if any such representation is filed by the petitioners herein the same be considered and appropriate action be taken by the respondent authorities, in accordance with law, within a period of four (4) weeks thereafter.
