THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE P.KESHAVA RAO W.P.NOS.33022 AND 34119 OF 2017 COMMON ORAL ORDER (Per SKK,J) In these two writ petitions, the prayer is common and writ petitioner is one and the same. He filed the writs of Habeas Corpus to declare the action of the respective respondents in detaining and curtailing the personal liberty of his son Movva Abhilash, as illegal and arbitrary and against fundamental rights and consequently direct the respondents to produce his son before the court.
In both the writ petitions, detailed counter affidavits have been filed. In W.P.No.33022 of 2017 it is stated that the petitioner is involved in number of criminal cases. In the counter affidavit, the respondents have shown the statement of criminal cases in which the son of the petitioner is involved and further stated that in Crime Nos.841 and 671 of 2013, registered against the alleged detenu for the offence under Section 382 of IP, on the file of Police Station, Kukatpally, he was produced before the Deputy Collector and Tahasildar and Executive Magistrate of Kukatpally Mandal, Rangareddy on 29.9.2017 and the learned Magistrate released him on obtaining a bail bond for maintaining good behavior for a period of six months, in default agreeing to pay Rs.50,000/-. In the counter affidavit in W.P.No.34119 of 2917, it is stated that the alleged detenu Movva Abhilash, the son of the writ petitioner, is accused in Crime Nos. 148/2016, 29/2017, 88/2017 and 118/2017 on the file of Ponnur
Urban Police Station for the offence under Sections 454, 457, 379 and 380 IPC. He was arrested on 9.10.2017 and stolen property was seized from him and he was produced before the court of Additional Junior Civil Judge, Ponnur on 10.10.2017 and the said court remanded him to judicial custody and he is lodged at Sub-Jail ,Bapatla on 10.10.2017. In view of the above averments made in the counter affidavits, no directions need be issued and the writ petitions are accordingly closed. No costs.
