THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.7344 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A-1 seeking to grant anticipatory bail in the event of his in Crime No.158 of 2019 of Women Police Station, Begumpet, Hyderabad. 2.

Heard learned counsel for the petitioner/A-1 and the learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

The brief facts of the case are that on 30.6.2019, the defacto complainant lodged a complaint stating that her marriage was performed with the petitioner-accused No.1 on 23.11.2017 and at the time of marriage, her parents gave dowry of Rs.6 lakhs, 6 tulas of gold and furniture worth Rs.2 lakhs to the accused; that one week after the marriage, the accused started harassing her physically and mentally for bringing additional dowry from her parents'

house;

that A-4brother-in-law used to abuse her in vulgar language and beat her for petty issues; that on 23.5.2018, the petitioner-accused No.1 hit her on nose by suspecting her character; that subsequently, she and the petitioner-accused No.1 shifted to Bangalore for job in June, 2018 and there also, accused No.1 used to harass her.

Learned counsel for the petitioner/A-1 submitted that the petitioner is innocent and is not connected with any of the alleged offences; that he is a private employee and in the event of his arrest, he may lose his job; that the petitioner is ready to cooperate with the prosecution in the process of investigation; and that the petitioner is a law abiding citizen and he undertakes to abide by any conditions imposed by this Court in the event of her release on anticipatory bail. 5.

Learned Additional Public Prosecutor has vehemently opposed to grant anticipatory bail to the petitioner. 6.

As seen from the contents of the complaint, there are specific allegations against the petitioner to the effect that he used to harass the defacto complainant physically and mentally demanding additional dowry and that on 23.5.2018, the petitioner hit the defacto complainant on her nose by suspecting her character and that unable to bear the harassment meted out to her, the defacto complainant attempted to commit suicide thrice.

Having regard to the nature of allegations levelled against the petitioner and the involvement of the petitioner in the aforesaid offences, I am not inclined to grant anticipatory bail to the petitioner.

The Criminal Petition is accordingly dismissed. However, if the petitioner surrenders before the Court below concerned within 15 days from today and files an application seeking bail,

the Court below shall consider the same and pass appropriate orders in accordance with law.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
