THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY A.S.M.P. No.3209 of 2017 IN/AND APPEAL SUIT No.448 of 2009 JUDGMENT:

This appeal is filed by the plaintiffs, under Section 96 of CPC, assailing the decree and judgment dated 08.4.2009 in O.S. No.225 of 2002 on the file of the Court of Principal Senior Civil Judge, Tenali, wherein and whereby the suit filed by the plaintiff for declaration and consequential possession of the suit schedule property, was dismissed. 2.

A.S.M.P. No.3209 of 2017 is filed by the petitionersappellant to permit them to compromise the matter with the respondents-defendants in terms of the Memorandum of compromise.

Mr.M.Koteswara Rao, learned counsel, representing Sri N.Subba Rao, learned counsel for the petitioners, identified petitioner Nos.1 to 4, 6, 7 and 9 to 17 in the open Court. Sri V.S.R. Anjaneyulu, learned counsel for the respondents, identified respondent Nos.1 and 2 in the open Court. Petitioner Nos.5 and 8 filed separate affidavits to permit the petitioner No.1 to sign on compromise in their behalf. 4.

Heard the learned counsel for both the parties and perused the record. This Court read over and explained conditions 1 to 6 of the Memorandum of Compromise to the

petitioners and respondents in Telugu and they admitted the same. The petitioners and respondents, in the open Court, submitted that they entered into compromise to put an end to the litigation at the advice of the elders.

Accordingly, A.S.M.P. No.3209 of 2017 is allowed. Consequently, the appeal is disposed of, in terms of the compromise. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
