O R D E R

Aggrieved by the proceedings No.134/ TC9/ SZ/ GHMC/ 2018 dated 21.05.2018 issued by the 2nd respondent in canceling the assessment and mutation of the names of the petitioners in respect of the subject property, the present writ petition is filed. Learned counsel appearing for the petitioners would submit that petitioners are absolute owners and possessors of the subject property and their names were mutated in the municipal records, but the 2nd respondent - Greater Hyderabad Municipal Corporation, Circle -9, (S.Z.), without issuing any notice and merely based on the judgment passed in a civil suit filed by the petitioners against the tenants, passed the impugned proceedings for deletion of the names of the petitioners in the municipal records, and this amounts to violation of principles of natural justice.

Heard the learned Government Pleader for Municipal Administration and Urban Development for 1st respondent and Sri Pasham Krishna Reddy, learned Standing Counsel for 2nd respondent. A perusal of the impugned proceedings goes to show that no notice has been issued to the petitioners, and on this ground alone, the impugned proceedings are liable to be set aside, and accordingly set aside.

It is made clear that if the 2nd respondent intends to take any further action, it is open to him to take such action in accordance with law after issuing notice and opportunity of hearing to the petitioners.

The writ petition is accordingly disposed of. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
