Guruvelli Rangarao, v. The Tahsildar,
THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.28217 OF 2007 ORDER:
This writ petition is filed, seeking to declare the action of the respondent in initiating action under the provisions of A.P. Assigned Lands (Prohibition of Transfers) Act, 1977, though there is no violation pointed out by the respondent and the action of the respondent in interfering with petitioners'
possession and enjoyment of the land without passing any order pursuant to show cause notice duly considering the explanation of the petitioners as arbitrary, illegal and without jurisdiction.
2.
The petitioners in this writ petition claimed to have right and interest upon the subject land by virtue of the pattas granted by the respondent and a show cause notice was issued by the respondent on the allegation of violation of conditions of A.P. Assigned Lands (Prohibition of Transfers) Act, 1977, for which, the petitioners filed their reply and the same is pending. 3.
The petitioners approached this Court under the threat of dispossession and this Court by order dated 28-12-2007 granted status-quo. Since then, the petitioners are in possession and enjoyment of the property and balance of convenience is in favour of the petitioners.
4.
Accordingly, the writ petition is disposed of, directing the respondent not to take any coercive steps for dispossessing the petitioners, without following due process of law. No order as to
costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
