THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1932 of 2015 ORDER:
Upon hearing both sides, at the admission stage, the following Order is passed:
It is seen that a private complaint filed by the complainant was taken cognizance by the learned Judicial First Class Magistrate, Guntakal, Ananthapur District, after conducting enquiry and taking evidence of the witnesses. As such, I am not inclined to quash the proceedings as sought for by the petitioners/Accused Nos. 1 to 5. However, if they are so advised, the petitioners can move discharge application putting forth all the defences available to them under law, in which case, the trial Court shall dispose of the same on merits expeditiously. Further, on the request of learned counsel for petitioner, the appearance of petitioners/Accused Nos.2 to 5 in C.C.No.431 of 2014 on the file of Judicial First Class Magistrate, Guntakal, is dispensed with except on the occasions when the trial Court requires their attendance.
With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
