THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.31398 of 2015 ORDER: (per SK,J) This writ petition was filed assailing the auction notice dated 28.08.2015 issued by the LIC Housing Finance Limited in relation to the secured asset belonging to the petitioners.

Sri Battula Raja Kiran, learned counsel for the first respondent corporation, states that the conditional interim order granted by this Court was not complied with. He further states that the sale proposed to be held pursuant to the auction notice dated 28.08.2015 did not materialise for want of bidders.

That being so, as the challenge in this writ petition is only to the said sale notice which has come to naught, we do not propose to adjudicate any issue raised in this writ petition on merits as the cause no longer survives. That apart, the petitioners also failed to comply with the conditional interim order granted by this Court. The writ petition is accordingly dismissed leaving all issues open. The petitioners are at liberty to invoke appropriate remedies available to them in law as and when a fresh cause of action arises. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
