Order: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the petitioners, after arguing this petition for some time, prays for withdrawal of the writ petition with liberty to the 5th petitioner to challenge G.O. Ms. No. 59, dated 13.5.1998, G.O. Ms. No. 39, dated 17.4.1997 and Section 15 of the Wild Life (Protection) Amendment Act, 1991 (Central Act 44/1991), in appropriate proceedings.
The writ petition is disposed of as withdrawn. It is open to the 5th petitioner to raise challenge to G.O. Ms. No. 59, dated 13.5.1998 and G.O. Ms. No. 39, dated 17.4.1997, if the law so permits in appropriate proceedings and also the consequent challenge of constitutional validity of Section 15 of the Wild Life (Protection) Amendment Act, 1991, (Central Act 44/1991). Consequently, miscellaneous petitions, if any, pending shall also stand closed. No costs.
