ORDER:

The petitioner alleges that the tender submitted by him in pursuance of the tender notification dated 01.12.2016 for construction of incomplete Nagarapanchayath office building in Parkal Nagarapanchayath is not considered on the ground that he is not qualified in accordance with the orders of the Government issued in G.O.Ms.No.66, Irrigation & CAD (Reforms) Department dated 20.04.2015.

The learned Standing Counsel appearing for the second respondent - Nagarpanchayat submits that there is no material filed by the petitioner to show that he has participated in the tender and that the tender document is not accepted on the ground now raised.

Admittedly, the petitioner has not filed any proof to substantiate his claim that he has submitted tender document.

Having regard to the submissions made, the Writ Petition is disposed of granting liberty to the petitioner to make a representation to the second respondent - Nagarpanchayat, Parkal, furnishing all the details with regard to his participation in the tender notification dated 01.12.2016, by 11.01.2017, and if such representation is filed, the second respondent shall consider the same and take appropriate decision thereon, before finalizing the tenders, if not already finalized. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
