HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.46035 of 2016 Order:

This Writ Petition was filed challenging the action of the second respondent in not releasing the stocks pursuant to registration of Crime No.141 of 2014, which ended in acquittal in C.C.No.243 of 2015 dated 26.08.2015.

If the allegation of the petitioner is correct, he can take appropriate legal proceedings in the concerned Court for release of the seized stock and the present Writ Petition under Article 226 of the Constitution of India is not a proper remedy.

In the circumstances, the Writ Petition is closed giving liberty to the petitioner to take appropriate legal proceedings in accordance with law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
