THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.21478 of 2009 ORDER:

The relief sought for in this writ petition is to declare the inaction of the respondents, in placing the proposal to accommodate the funds in the action plan for 2009 and 2010 for construction of a compound wall to the Avatar Mehar Baba Temple, as arbitrary and illegal. While it is debatable whether a mandamus can be issued to the Government to provide funds for construction of religious structures, it is wholly unnecessary for this Court to examine this question, as the relief sought for is for funds to be provided, in the action plan 20092010, which period expired seven years ago. The cause in the writ petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous.

The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
