THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2374 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-2 in Crime No.65 of 2016 of Madhapur Police Station, Cyberabad, Ranga Reddy District registered for the offences punishable under Sections 294 and 188 IPC.

Heard the learned counsel for the petitioner/accused No.2 and the learned Public Prosecutor and perused the material available on record.

The main contention of the learned counsel for the petitioner/ A-2 is that she is not residing in Hyderabad and is continuously staying at Mumbai till today and she is no way concerned with the alleged offences. It is further contended that the alleged premises, which is being used as Guest House, was let out and she is not aware of happening of the activities in the Guest House. The truth or otherwise of the allegations in the complaint and the involvement of the petitioner/A-2 will be ascertained only after a due investigation and the same cannot be determined by this Court at this stage.

Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against the petitioner, this Court is not inclined to quash the proceedings against the petitioner/accused. However, at this stage, learned counsel for the petitioner/A-2 stated that the petitioner is apprehending arrest of the petitioner in view of pendency of the crime. Considering the said request, the Madhapur Police Station,

Cyberabad, Ranga Reddy District is hereby directed to complete the investigation without arresting the petitioner/A-2 and file final report into the Court. The petitioner/A-2 is directed to appear before the Investigating Agency as and when their presence is required and cooperate with the Investigating Agency. With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
