ORDER

The grievance of the petitioner is that his date of birth was incorrectly entered in the service record and based on the incorrect entry, the respondents are trying to retire him prematurely. As per his driving license/service register, he is entitled to continue in service till he attains the age of superannuation.

Learned counsel appearing for the petitioner submits that appropriate orders be passed directing the respondents to refer the case of the petitioner to the age determination committee to ascertain his correct age.

Learned Standing Counsel appearing for the respondents contends that the case of the petitioner would be referred to the age determination committee for ascertaining his correct age.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition can be disposed of directing the respondents to refer the case of the petitioner to the age determination committee for ascertaining his correct age. It is needless to say that the age determination committee shall give an opportunity to the petitioner to put forth his case before passing appropriate orders. The said exercise shall be completed within a period of eight (08) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
