THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.15139 of 2014 ORDER:

This Criminal Petition is filed by the petitioners-A1 to A3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.570 of 2012 on the file of the II Additional Chief Metropolitan Magistrate, Vijayawada.

Heard and perused the material available on record. It is alleged that the marriage of the 2nd respondent was performed with A1. At the time of marriage, her parents offered Rs.8 lakhs towards dowry besides house site to them and all the accused demanded that her salary has to be given to them. The parents of the 2nd respondent agreed for all demands. After marriage, with the support of A2 to A4, A1 harassed her on one pretext or the other. All the accused pledged the gold ornaments of the 2nd respondent without her knowledge and they also transferred the title of house property. On coming to know about the same, the mother and grand-parents of the 2nd respondent requested for return of the documents, gold and dowry amount. But the accused did not return the same.

Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of petitioners-A1 to A3 before the trial Court is dispensed with except on the date of framing of charges, if any, and on the date of their examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment in the above C.C. The petitioners are directed to be represented by their Counsel before the trial Court on all hearing dates.
