HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Contempt Case No.1440 of 2016 Order:

This Contempt Case is filed alleging non-implementation of the order in W.P. No. 32319 of 2015 dated 09.10.2015 whereunder this Court directed the second respondent to furnish the relevant documents relating to the charges against the petitioner and gave liberty to the second respondent to proceed with the enquiry. It was also directed to pay the subsistence allowance for the months of July to October 2015 and continue to pay the same to the petitioner during the period of suspension.

Now the learned Sanding Counsel appearing for the respondents submitted that the subsistence allowance was paid till July 2016 and the petitioner was removed from service by an order dated 05.08.2016. 3.

In view of the same, nothing survives for consideration in the Contempt Case and the Contempt Case is, accordingly, closed. However, if the petitioner has any grievance with regard to enhanced subsistence allowance, it is open to him to take appropriate proceedings. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
