THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.23065 of 2002 ORDER:
This writ petition is filed with the following prayer: "to issue an appropriate writ, order or direction more particularly in the nature of mandamus declaring the action on the part of the first respondent in not protecting the wakf properties and failed to comply with the directions granted in A.S.No.40 of 1991 as confirmed in S.A.No.605 of 1993 as illegal, arbitrary, capricious and malafide amounting not only dereliction of duty but also failed to discharge the statutory duties imposed on the first respondent under Section 25 of the Wakf Act, 1995 and pass such other order or orders".

Respondents filed counter affidavit.

Learned counsel for the respondents, reiterating the averments in the counter-affidavit, submits that the respondents had issued a notice to the petitioner on 25.11.2002 directing him to appear before the then Chief Executive Officer on or before 12.12.2002 along with all relevant documents in proof of his claim, and that the then Chief Executive Officer had also issued a memo dated 21.12.2002 to the Inspector-Auditor, Wakfs, Cuddapah District, to be present at the time of visit by the Chief Executive Officer for conducting enquiry and thereafter, survey was conducted and enquiry report was submitted on 08.01.2003, based on which, an errata was issued on 26.04.2008 and the same was published in the Gazette on 15.05.2008 by correcting the anomaly.

In view of the aforesaid submission of the learned counsel for the respondents, the purpose of filing the writ petition has already been worked out. Hence, the Writ Petition is closed as no further orders are required. No order as to costs.
