Heard learned counsel for the petitioner, and the learned Standing Counsel for the respondent-Corporation.
The sum and substance of the grievance of the petitioner is that the proposal to establish an Indian Oil petrol pump by one Y. Ravinder Reddy (for short, 'the applicant') in the land in Survey No.927/A situated at State Highway-2 on the road from Nadipahad X Road, State Highway-2 towards Hyderabad, does not meet the conditions/guidelines stipulated in Circular No.IRC:12-2009 and IRC:12-2016. Bringing out these aspects, the petitioner asserts that he had submitted a letter to the Chief Divisional Retail Sales Manager, Indian Oil Corporation Limited (the 3rd respondent) on 24.09.2019, however, as there is no action forthcoming from the 3rd respondent, he seeks a Writ of Mandamus directing the respondent authorities to stop the establishment of petrol pump at the said location as the same is not in conformity with the Circular guidelines.
Learned Standing Counsel would submit that the application of the applicant who was selected to be an agent of the respondent-Corporation would be considered in accordance with law before granting permission for establishing the petrol pump. Having regard to the prayer of the petitioner, and also the submission of the learned Standing Counsel for the respondent-Corporation, the writ petition is disposed of by observing that the respondent-Corporation shall take into consideration the parameters laid down in the Circular guidelines, and also the aspects which the petitioner brought to the notice of the 3rd respondent vide his letter dated 24.09.2019, before granting permission to the applicant for establishing the petrol pump.
