HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No. 294 of 2012 JUDGMENT:

This appeal is preferred against order dated 18.01.2012 in I.A.No.959 of 2011 in O.S.No.830 of 2011 on the file of I Additional Senior Civil Judge, Kakinada.

2. Appellant herein is plaintiff and he filed O.S.No.830 of 2011 for the relief of permanent injunction and in that suit he filed I.A.No.959 of 2011 seeking temporary injunction. The trial Court on a consideration of material on record dismissed the application. Aggrieved by the same, present appeal is preferred.

3. As per the office note, O.S.No.830 of 2011 was disposed of on 04.09.2012. As the main suit is disposed of, nothing survives in this appeal for adjudication. When this matter is listed under the caption 'specially identified cases', no interest is evinced in prosecuting the case.

4. For these reasons, this appeal is dismissed for nonprosecution.

5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
