K. Sarojana, v. The State Of Telagana,
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE THIRTIETH DAY OF MARCH TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.7619 of 2015 BETWEEN K.Sarojana and others ... PETITIONERS AND The State of Telangana, Rep. by its Principal Secretary (Department of Home), Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. The grievance of the petitioners in this writ petition is that respondent No.3-police are unnecessarily calling the petitioners to the police station and compelling them to sit in the police station till evening without registration of any crime.
3. Instructions of the learned Government Pleader, however, show that as on 25.03.2015, no case is registered against the petitioners either on the file of III Town police station as well as Woman Police Station, Karimnagar. However, on the complaint filed by one Smt. Deverakonda Sravani, dated 23.02.2015, before the Collector, Karimnagar, the Superintendent of Police, Karimnagar, was directed to enquire into the same and in turn, he directed the Station House Officer, III Town Police Station, to make further enquiries and it is only at the stage of preliminary enquiry. It is also stated that neither petitioners were summoned nor they were made to sit in the police station, as alleged.
4. In view of that, no orders, at present, are required to be passed in this petition. However, respondent-police are directed to conduct preliminary enquiry and, only if a crime is registered against the petitioners, take appropriate action in accordance with law. Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V.
