THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.33445 of 2017 ORDER:
This Writ Petition is filed challenging the inaction of the third respondent in taking action on the proposal submitted by the Tahsildar for bifurcation of the fair price shops in Anjalipuram Village, Huzurnagar Mandal in Suryapet District. The petitioner is the Vice President of Huzurnagar Mandal Praja Parishad having been appointed as MPTC from Lakkavaram Village. Anjalipuram Village falls within the Mandal. It is his case that the Anjalipuram village is not having any fair price shop and the villagers are getting the essential commodities from the neighbouring Village - Amaravaram, from three different shops which are situated at 2 Kms away.
He states that he submitted a representation to the fourth respondent and on the basis of the representation, the fourth respondent submitted a report to the third respondent and in spite of the same, the third respondent is not taking any action. In those circumstances, the present Writ Petition is filed challenging the inaction of the third respondent. Learned Government Pleader submits that the Government of Telangana issued G.O.RT.No.55, dated 12.05.2015 providing for rationalization of fair price shops on the basis of cards held by each shop in different areas in the State. Thereafter, a circular was issued on 27.10.
ahead with the process of rationalization of fair price shops but the action for appointment of the fair price shop dealers may be kept in abeyance until further orders, and in view of the same, the third respondent might not have taken any action. This Court feels that it is purely an administrative action and the third respondent has to take a decision in this regard. In the circumstances, this Writ Petition is disposed of leaving it open to the third respondent to take the action and, if necessary, communicate the same to the petitioner in this regard as expeditiously as possible based on the existing Government Orders and circulars. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
