THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.32661 of 2017 ORDER:

This writ petition is filed seeking to issue a writ, order or direction more particularly one in the nature of mandamus declaring the action of the respondents in not considering the petitioners' representations dated 31.08.2017 and 13.09.2017 as illegal and violation of Articles 14, 16 and 19 (1)(g) of the Constitution of India.

It is a case of the petitioners that the petitioners are registered societies and they were submitted proposals to the respondents to establish schools of nursing in their respective places. It is further case of the petitioners that on the requests made by the petitioners, the first respondent has issued a letter No.1094/E.1/2015-1, dated 06.02.2015, along with the copies of proposals submitted by the petitioners, to the 2nd respondent to send a inspection report if already inspected for taking further action immediately. Since the proposals of the petitioners were misplaced, the petitioners again requested the second respondent to conduct inspection on the proposals of the petitioners. But the second respondent has not taken any action on the representation of the petitioners. 2.

Heard the learned counsel for the petitioners and learned Government Pleader for Heath, Medical and Family Welfare appearing for the respondents.

Learned counsel appearing for the petitioners submits that for the aforesaid relief, the petitioners filed representations for proposals dated 31.08.2017 & 13.09.2017 to the respondents, but no decision has taken till today.

Learned Government Pleader for the respondents submits that the decision of the Government on the proposals dated 31.08.2017 & 13.09.2017 made by the petitioners, shall be taken, within a period of six weeks.

Accordingly, keeping in view of the averments made in the petition and the submissions made by the learned Government Pleader appearing for the respondents, the writ petition is disposed of with a direction to the respondents to consider the representation dated 31.08.2017 & 13.09.2017 and pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. No costs.

As a sequel, miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
