Akula Hemalatha, v. Sri.R.V. Karvan,
HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CONTEMPT CASE No.18 of 2017 ORDER:
1.
The present Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act stating that the respondents have willfully and deliberately disobeyed the order dated 08.09.2015 passed by this Court in W.P.No.28932 of 2015. 2.
A perusal of the material placed on record would show that this Court while disposing of W.P.No.28932 of 2015, directed the Tahsildar, Jaipur Mandal to pass orders on the representation dated 25.02.2015 made by the petitioner seeking physical possession of the land in Survey No.94, admeasuring Ac.8.90 gts., of Jaipur Village and Mandal, Adilabad District, in accordance with law, within six weeks from the date of receipt of a copy of the order. The inaction on the part of the Tahsildar, lead to filing of the present contempt case. 3.
Today, when the matter is taken up for hearing, the Government Pleader for Revenue placed on record the proceedings No.A/ 160/ 2016, dated 04.04.2017, wherein the Tahsildar passed an order pursuant to the representation dated 25.02.2015, seeking physical possession of the land.
4.
Having regard to the fact that the Tahsildar, Jaipur, has already considered the representation and passed orders on 04.04.2017, it cannot be said that there was any willful disobedience of the order passed by this Court. Hence, the Contempt Case is closed.
-25.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
