HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22091 OF 2018 O R D E R :

This writ petition is filed declaring the action of the respondents in not registering crime on petitioner's complaint dated 07.06.2018 against the 6th respondent.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that petitioner has given complaint to the 5th respondent through post which was received by the 5th respondent on 14.06.2018; that on the same day general diary entry was made; that on perusal of the complaint as it was found that the jurisdiction of the said offence comes to Donakonda P.S., Podili Circle, Darsi SubDivision, the respondent No.5 has sent Police Constable No.2548 to the house of petitioner to know about the details of his complaint, but as the petitioner was not residing in the given address a special report was also prepared. Further, as the petitioner has not mentioned any contact number in the complaint, the 5th respondent has sent a notice to the petitioner through courier on 23.06.2018; and that action will be taken as per law if petitioner approaches the respondent police.

In this case when once it is found that the subject matter of the complaint does not fall within the jurisdiction of the 5th respondent he should have transferred the same to the

concerned police station. It is not known why such procedure is not followed by the 5th respondent.

In view of the same, the 5th respondent is directed to transfer the complaint of the petitioner to the concerned police station having jurisdiction and on such transfer the concerned police station is to take appropriate action on the said complaint, in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 09.07.2018 t k.
