Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner is the General Power of Attorney holder of one Sri K.Sanyasi, who purchased an extent of Ac.0.32 cents of dry land in new Survey No.484 (old Survey No.417) of Narava Village of Pendurthi Mandal in Visakhapatnam District, under a registered sale deed dated 13.01.1968. The property originally belonged to one Sri Budi Reddy Bapi Naidu and others. The purchaser, Sri K.Sanyasi, was in possession of the property and executed the Power of Attorney in favour of the petitioner on 18.01.1985 and the same was registered as Doc.No.45/1985 in the Office of the Joint Sub-Registrar, Visakhapatnam. Later on Sri K.Sanyasi expired. While so, the second respondent came to the site on 20.07.2005 and tried to dispossess the petitioner from the said property. In those circumstances, the present Writ Petition was filed.
This Court, by order dated 22.07.2005, directed the respondents not to dispossess the petitioner without following due process of law. In the circumstances, this Writ Petition is disposed of directing the respondents not to interfere with the possession of the petitioner without following due process of law.
